1. Acceptance of Terms

By creating an account or using the KasadPay merchant platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. These terms apply to all merchants, users, and any other parties who access the Service.

2. Account Registration

To use KasadPay, you must register for a merchant account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are liable for all activities that occur under your account.

3. Permitted Use

You may use the Service only for lawful business purposes. You agree not to:

• Use the Service for any illegal or fraudulent activity.
• Process transactions for prohibited goods or services as defined in our Acceptable Use Policy.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Reverse engineer, copy, or distribute any component of the platform.
• Interfere with the integrity or performance of the Service.

4. Fees and Billing

Applicable transaction fees, service charges, and billing terms are outlined in your merchant agreement or as displayed within the platform. KasadPay reserves the right to modify fees with reasonable notice. Continued use of the Service after a fee change constitutes acceptance of the new fees.

5. Withdrawals and Balances

Funds held in your KasadPay balance are subject to our settlement and withdrawal policies. Withdrawal requests are processed according to the timelines and limits defined in your merchant agreement. KasadPay may suspend withdrawals if fraudulent activity or a policy violation is suspected.

6. API and Integrations

Access to the KasadPay API is governed by these Terms and any supplemental API documentation. You are responsible for securing your API keys. Misuse of the API, including excessive requests, scraping, or unauthorized automation, may result in suspension of API access.

7. Limitation of Liability

To the maximum extent permitted by applicable law, KasadPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities. Our total liability to you for any claim shall not exceed the fees paid by you to KasadPay in the three months preceding the claim.

8. Suspension and Termination

KasadPay may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion with reasonable notice where required by law. Upon termination, your right to access the Service ceases immediately. Outstanding balances will be settled according to our policies.

9. Modifications to the Service

KasadPay reserves the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes. Continued use of the Service constitutes acceptance of any modifications to these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts as specified in your merchant agreement.
